Labeled Into a Corner: How Narrow FDA Indications Leave Clinicians—and Patients—Without Options

Approval is not the same as endorsement. Nor is the absence of an approved indication equivalent to a lack of evidence. Yet in the day-to-day reality of US clinical practice, the line between what the FDA has formally labeled and what a medication can meaningfully accomplish often determines whether a patient receives a therapy—not the quality of the science behind it.
This is the central contradiction of precision medicine in the modern era: as our understanding of disease biology becomes increasingly granular, the administrative and regulatory structures governing drug access have struggled to keep pace. The result is a system in which clinicians who understand the pharmacology, have reviewed the literature, and have exhausted standard options may still find themselves unable to prescribe the most appropriate treatment—because a payer's coverage algorithm begins and ends with the package insert.
How Indications Become Constraints
The FDA approval process is designed around a specific question: does this drug work for this indication, in this population, as demonstrated by this clinical trial? That framing is intentional. Rigorous, indication-specific trials protect patients from premature or unsupported use. But the same precision that makes the approval process scientifically defensible can render approved indications frustratingly narrow.
Consider the trajectory of many oncology agents. A drug may earn accelerated approval for a rare tumor type in a heavily pretreated population, only for subsequent research to demonstrate meaningful activity across a broader range of histologies or earlier lines of therapy. The science evolves in real time; the label does not. Supplemental applications take years, require substantial resources, and are often deprioritized by manufacturers once a drug has lost patent exclusivity and the financial incentive to pursue additional approvals has evaporated.
This dynamic is not limited to oncology. Neurological conditions, rare pediatric diseases, autoimmune disorders, and psychiatric illness all carry substantial off-label prescribing burdens—not because clinicians are operating recklessly, but because FDA-approved alternatives are either absent, inadequate, or associated with tolerability profiles that preclude long-term use.
The Liability Equation
Prescribing outside an approved indication is legal in the United States. The FDA explicitly acknowledges that the practice of medicine is not within its jurisdiction to regulate, and off-label use is both common and well-established across virtually every specialty. What the regulatory framework does not protect against, however, is the intersection of off-label prescribing with medical liability.
For many clinicians, the concern is not regulatory sanction—it is the evidentiary standard that would apply in a malpractice proceeding. When an adverse outcome occurs in the context of off-label therapy, the absence of an FDA-approved indication can be leveraged to suggest deviation from standard of care, regardless of whether published evidence supported the decision. This exposure creates a chilling effect that discourages some clinicians from pursuing otherwise reasonable therapeutic options, particularly in lower-volume practices without access to robust institutional support.
The liability calculus is further complicated by documentation norms. A prescriber who has carefully reviewed the literature, documented clinical rationale, obtained informed consent, and exhausted approved alternatives is in a meaningfully different position than one who has not. Yet that distinction is rarely reflected in how payers evaluate prior authorization requests or how risk managers advise clinical staff.
Payers as De Facto Regulators
Perhaps the most consequential force shaping off-label access is not the FDA at all—it is commercial and government payers. Formulary design, prior authorization criteria, and step therapy protocols collectively function as a secondary regulatory layer, one that is neither transparent nor consistently evidence-based.
Most commercial payers in the United States rely on drug compendia—resources such as the National Comprehensive Cancer Network (NCCN) guidelines, Micromedex, or the American Hospital Formulary Service—to determine coverage eligibility for off-label use. In oncology, this framework provides some degree of access to evidence-supported regimens. Outside of oncology, coverage standards are far more variable, and payers retain broad discretion to deny claims on the basis of indication alone, irrespective of published clinical data.
For patients, this translates into a familiar and demoralizing sequence: the prescriber recommends a therapy, the prior authorization is denied, the appeal is denied, and the patient either pays out of pocket—often at a cost that is prohibitive—or goes without. For clinicians, it represents an erosion of prescribing authority that is rarely discussed openly but is felt acutely in complex cases.
Building a Defensible Clinical Rationale
For clinicians navigating these barriers, the most effective strategy is one grounded in documentation rigor and systematic escalation. The following framework reflects best practices for pursuing off-label access when standard options have been exhausted.
1. Establish the evidentiary foundation. Prior to initiating an authorization request, compile peer-reviewed literature supporting the proposed use. Systematic reviews, prospective trials, and guideline statements from relevant specialty societies carry the most weight. Compendia citations, where applicable, should be referenced explicitly, as many payers are contractually obligated to cover uses listed therein.
2. Document clinical necessity with specificity. The prior authorization letter should articulate not only why the proposed therapy is appropriate, but why approved alternatives are insufficient—whether due to contraindication, prior treatment failure, tolerability concerns, or the absence of any approved option. Vague appeals to clinical judgment are far less effective than a precise account of the patient's treatment history and current clinical status.
3. Invoke the appeals process deliberately. Initial denials are not final determinations. Most payers are required under federal and state law to provide an internal appeal pathway, and external independent review is available in most states for certain coverage disputes. Peer-to-peer reviews—direct conversations between the treating clinician and the payer's medical director—can be particularly effective when the denial reflects a formulaic application of coverage criteria rather than a substantive clinical disagreement.
4. Explore parallel access pathways. Manufacturer patient assistance programs, expanded access protocols, and investigational use exemptions may provide access to therapies that payers will not cover. These pathways are administratively burdensome but should not be dismissed as impractical, particularly for patients with serious or life-limiting conditions.
5. Obtain and document informed consent. When off-label therapy proceeds, the informed consent process should explicitly acknowledge the regulatory status of the proposed use, the evidence supporting it, and the known or theoretical risks. This documentation serves both an ethical and a medicolegal function.
Rethinking the Standard of Care
The phrase "standard of care" is frequently invoked as though it were a static, objectively defined benchmark. In practice, it is a dynamic construct—one that reflects evolving clinical evidence, expert consensus, and the therapeutic options available at a given point in time. When the evidence base for a therapy outpaces its regulatory labeling, the standard of care and the approved indication may point in different directions.
Clinicians who understand this distinction, and who are equipped to document and defend their reasoning, are better positioned to advocate for patients whose needs exceed what any label can fully anticipate. Precision prescribing, in its truest sense, is not the mechanical application of approved indications—it is the disciplined, evidence-informed exercise of clinical judgment in service of the individual patient.
The label is a starting point. It should never be the last word.
